A federal judge on Thursday defended a $9.5 million payment made to a patient who allegedly paid the wrong price for erectile dysfunction drugs.
The money was sent to a Missouri patient who allegedly paid $1,000 for the drug.
“This is not a case of money and I have no desire to be a judge or a representative of the state of Missouri,” Missouri’s U. S. Attorney’s Office said in a statement. “This is not a case of money and I will vigorously defend this case.”
In a lawsuit filed in April in the U. District Court for the Eastern District of New York, the plaintiff, William L. Derry, also allegedly paid $9,500 to purchase Viagra, or the generic drug brand, from a drugstore in the South Florida area.
Derry received the money after he was arrested in March after he allegedly paid more than $4,000 to buy the drug from a friend and his partner.
The case was being prosecuted by the U. Attorney’s Office and is being handled by Assistant U. Attorney Matthew N. Davis.
The case was brought by Derry, a man who pleaded guilty to a charge of money laundering, according to the lawsuit.
The money came from an investigation by the Drug Enforcement Administration, an agency that works to stop drug counterfeit products, and was returned to him after he was arrested in April.
The suit was filed by an ex-smorter of a woman who was arrested in a sexual assault case.
Derry had previously pleaded not guilty to the crime and was scheduled to be sentenced in May.
The suit alleges that the money was intended to be used as a cash payment to a person named in the investigation.
In April, Derry agreed to pay $9,500 for the drugs, which he was charged with illegally, the suit alleges.
“The defendant has committed a criminal offense and was convicted of an offense,” the suit said.
Derry’s lawyers are asking the judge to overturn that decision and to reconsider the sentence.
Derry’s lawyer is also appealing the $9,500 payment. Derry is scheduled to be sentenced in May.
In a separate news release, Derry’s lawyer stated that the suit alleges that the money was intended to be used as a cash payment to a person named in the investigation.

“The government has filed a complaint with the federal government seeking to have the government’s case heard,” said U. Attorney Michael J. Sullivan, spokesman for the attorney’s office.
The lawsuit is being prosecuted by the Department of Justice and is being handled by Assistant U.
The defendant, who is listed as being an individual in the case, has not yet reached a decision.
“I am disappointed in the defendant’s actions and will continue to vigorously defend this case,” Davis said.
